Terms of Service

1. Agreement to terms
By creating an account or using the Skarmly platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Skarmly AB, a company registered in Sweden.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of service
Skarmly is a digital signage management platform that allows you to upload media content, create playlists and schedules, pair Android TV devices, and remotely manage content displayed on those devices.
3. Account registration
- You must provide a valid email address and accurate information.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- One person or organization may not maintain more than one free account.
4. Acceptable use
You agree not to:
- Upload or display content that is illegal, harmful, or infringes on third-party intellectual property rights.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the Service to transmit malware, viruses, or other harmful code.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service in any way that could damage, disable, or impair our infrastructure.
- Resell or redistribute the Service without written permission.
5. Content ownership
You retain all rights to the content you upload to Skarmly. By uploading content, you grant us a limited license to store, process, and deliver that content to your paired devices as part of the Service.
We do not claim ownership of your content and will not use it for any purpose other than providing the Service.
6. Plans and billing
- The Starter plan is free and includes up to 3 screens and 5 GB of storage.
- Paid plans (Pro and Business) are billed monthly or annually per screen.
- You may upgrade or downgrade your plan at any time. Downgrades take effect at the end of the current billing period.
- We reserve the right to change pricing with 30 days' notice. Existing subscribers will be honored at their current rate for the remainder of their billing period.
7. Service availability
We aim to maintain 99.8% uptime for the Service. However, we do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by circumstances beyond our control (force majeure).
8. Data and privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.
9. Termination
- You may close your account at any time by contacting us at [email protected].
- We may suspend or terminate your account if you violate these Terms, with notice where practicable.
- Upon termination, your content will be retained for 30 days to allow data export, then permanently deleted.
10. Limitation of liability
To the maximum extent permitted by law, Skarmly AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
11. Governing law
These Terms are governed by the laws of Sweden. Any disputes arising from these Terms shall be resolved by the courts of Sweden.
12. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice in the dashboard at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance.
